{"id":4169,"date":"2021-07-26T05:24:46","date_gmt":"2021-07-26T05:24:46","guid":{"rendered":"https:\/\/www.legalario.com\/blog\/?p=4169"},"modified":"2023-11-08T19:57:14","modified_gmt":"2023-11-08T19:57:14","slug":"nueva-ley-de-outsourcing-en-mexico-2021","status":"publish","type":"post","link":"https:\/\/legalario.com\/blog\/nueva-ley-de-outsourcing-en-mexico-2021\/","title":{"rendered":"Nueva ley de outsourcing en M\u00e9xico 2021"},"content":{"rendered":"\n<p>La reforma a la <a href=\"http:\/\/www.diputados.gob.mx\/LeyesBiblio\/pdf_mov\/Ley_Federal_del_Trabajo.pdf\" rel=\"nofollow\">Ley Federal del Trabajo<\/a> sobre la subcontrataci\u00f3n laboral, tambi\u00e9n conocida como outsourcing, entr\u00f3 en vigor desde el d\u00eda 24 de abril de 2021, pero <strong>\u00bfEn qu\u00e9 consiste la nueva ley de outsourcing en M\u00e9xico 2021?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Proh\u00edbe la subcontrataci\u00f3n de personal por un tercero. Las agencias de reclutamiento de personal o intermediarios podr\u00e1n participar en el proceso de selecci\u00f3n y capacitaci\u00f3n de empleados, pero de ninguna forma tendr\u00e1n la <strong>calidad de patrones<\/strong>. <\/li>\n\n\n\n<li>Los derechos y obligaciones de un patr\u00f3n recaer\u00e1n \u00fanicamente en la empresa para la que la persona trabaja. <\/li>\n\n\n\n<li>Se autoriza la subcontrataci\u00f3n de servicios especializados siempre que no formen parte de la actividad principal de la empresa  y se cumplan  los siguientes requisitos: 1.- La contrataci\u00f3n deber\u00e1 formalizarse con un contrato por escrito, indicando el n\u00famero de trabajadores que participar\u00e1n. 2.- La empresa tendr\u00e1 que estar previamente registrada en el Padr\u00f3n que se\u00f1ale <a href=\"https:\/\/www.gob.mx\/stps\/\" rel=\"nofollow\">Secretar\u00eda del Trabajo y Previsi\u00f3n Social (STyPS). &nbsp;<\/a>&nbsp;<\/li>\n\n\n\n<li>Respecto al Reparto de Utilidades ser\u00e1 por un monto m\u00e1ximo de 03 meses del salario del trabajador o el promedio del dinero recibido en los \u00faltimos 03 a\u00f1os, aplicando el monto m\u00e1s alto y favorable para el empleado.&nbsp; <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Beneficios de la Nueva ley de outsourcing en M\u00e9xico 2021<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Evita abusos y violaci\u00f3n de los derechos de trabajadores .<\/li>\n\n\n\n<li>Empresas abandonar\u00e1n las pr\u00e1cticas de utilizar terceras compa\u00f1\u00edas que contraten a su personal.<\/li>\n\n\n\n<li>Reduce la evasi\u00f3n de impuestos en materia patronal y de seguridad social.<\/li>\n\n\n\n<li>M\u00e1s trabajadores comienzan a cotizar en el Seguro Social.<\/li>\n\n\n\n<li>Se aumentan las probabilidades de que un trabajador pueda acceder a un cr\u00e9dito <a href=\"micuenta.infonavit.org.mx\" rel=\"nofollow\">Infonavit<\/a>, gracias a las aportaciones patronales.<\/li>\n\n\n\n<li>Al reducir el n\u00famero de empleados <a href=\"https:\/\/www.legalario.com\/contrato-individual-trabajo\/start\">contratados<\/a> de forma externa, se fomenta el sentido de pertenencia a la organizaci\u00f3n contrat\u00e1ndose de forma directa.<\/li>\n\n\n\n<li>Aumento En el caso del reparto de utilidades en favor de los trabajadores<\/li>\n\n\n\n<li>Incrementos en el registro de salarios ante el <a href=\"http:\/\/www.imss.gob.mx\/\" rel=\"nofollow\">Instituto Mexicano del Seguro Social<\/a> que van del 15 hasta el 32% por ese tipo de transferencias laborales.<\/li>\n\n\n\n<li>En caso de <a href=\"https:\/\/www.legalario.com\/landings\/descargas\/carta_renuncia.pdf\">renuncias<\/a> o despidos el trabajador podr\u00e1 demandar m\u00e1s f\u00e1cilmente el cumplimiento de sus derechos laborales.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfQu\u00e9 pasa si una empresa incumple con la Nueva ley de Outsourcing en M\u00e9xico 2021?<\/h2>\n\n\n\n<p><strong>Multas <\/strong>que van de los 180 mil a los 4 millones de\npesos a quien realice o preste servicios subcontrataci\u00f3n de personal sin contar\ncon el registro correspondiente.<\/p>\n\n\n\n<p>Por no permitir la entrada a las autoridades laborales para\ninspecci\u00f3n y no presentar en tiempo y forma cualquier informaci\u00f3n solicitada, se\nprev\u00e9 la imposici\u00f3n de una <strong>multa<\/strong> de hasta 448,000 mil pesos.<\/p>\n\n\n\n<p><strong>Prisi\u00f3n<\/strong>.
